This SwyftOps Privacy Policy (“Policy”) is between users (“user(s)” or “you” or “your”) of any part of the SwyftOps application and associated downloadable apps, as well as any part of the SwyftOps website www.SwyftOps.com, an e-commerce site, (collectively the “Network”) and Aegle Technologies LLC dba SwyftOps (“SwyftOps” or “us” or “we” or “our”). This Policy governs associated data collection and usage. Your use of the Network demonstrates implied acceptance of this Policy without condition.

SwyftOps is an operating system that helps home care agencies and similar businesses streamline processes and make operations flow more smoothly and seamlessly. The information we collect and store enables us to provide services, communicate with you per your request, and enables your access to and use of the Network.

Please read this Policy carefully to learn how we handle your personal information. We reserve the right, in our sole discretion and without notice, to change this Policy – for example, when there are changes in our services, changes in our data protection practices, or changes in the law. The most current version of the Policy will supersede previous versions. We encourage you to periodically review this Policy so that you remain aware of what information we may collect, how we may use it, and under what circumstances we may disclose it.

Your use of the Network is also governed by our Network Terms & Conditions and, if applicable, your SaaS (software-as-a-service) agreement with us.

We are committed to protecting your privacy and we strive to keep personal information confidential. We have suitable physical, electronic and managerial procedures to safeguard and secure the personal data we collect. We operate secure data networks protected by industry standard firewalls and password protection systems. Our security and privacy policies are periodically reviewed and enhanced as necessary. Only authorized individuals have access to personal data. We will take reasonable technical and organizational precautions to prevent the loss, misuse or alteration of personal data.

We do not sell, trade, lease, or rent personal information to others. If you choose to provide us with personally identifiable information (any information by which you can be identified) we will only use it to support your customer relationship with us.

Collection of your Personal Information

We collect no personal information except that which you voluntarily provide. However, to use certain products or services you may be required to provide certain personal information . This may include when: (a) registering for an account; (b) entering a sweepstakes or contest; (c) signing up for special offers from third parties; (d) sending email messages; and/or (e) submitting your credit card or other payment information. We will use your information for, but not limited to, communicating regarding services and/or products you have requested. We also may gather additional personal or non-personal information in the future.

Information that We Collect

In the course of operating the Network, we may collect the following information:

  • Information that you voluntarily provide – for example, when filling out forms on the Network.
  • Information that we collect automatically – this may include device IP addresses, location data, browser and domain data, country data, access times, and/or referring website addresses.
  • Information provided to us when you communicate with us for any reason.

Sharing Information with Others

We may share data with third-parties that help us perform statistical analysis, send emails or postal mail, provide customer support, or arrange for deliveries. Such third-parties are prohibited from using personal information except to provide these services and they are required to maintain the confidentiality of your information.

We may disclose your personal information, without notice if required by law or in the good faith belief it is necessary to: (a) comply with laws; (b) enforce or apply terms of our SaaS agreements, (c) protect and defend our rights or property; and/or (d) protect the rights, property, or safety of others.

Tracking User Behavior

We may keep track of your activity within the Network in order to determine what services are popular or how they are being used. This data may be used to deliver customized content and advertising when behavior indicates interest in a particular subject or suboptimal use of services.

Use of Cookies

The Network may use “cookies” to help personalize online experiences. Cookies are text files that are placed on hard disks by a web page server. Cookies cannot be used to run programs on or deliver viruses to your computer. Cookies can only be read by a web server in the domain that issued the cookies.

Cookies are a convenient feature to save you time. Cookies tell web servers that you have returned to a specific Network page. For example, if you personalize a page, or register with the Network for services, cookies recall your specific information during return visits. This simplifies the process of submitting personal information such as billing addresses, shipping addresses, and so on. When you revisit the Network, information you previously provided can be retrieved so you can easily use the Network features.

You can accept or decline cookies. Your web browser may automatically accept cookies, but you can usually modify your browser settings to decline them. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Network.

Linked Sites

The Network may contain links to other sites. We are not responsible for the content or privacy practices of linked sites. If you leave the Network, you should read the privacy policies of any linked sites that may collect personally identifiable information.

Security of Your Personal Information

We secure your personal information from unauthorized access, use, or disclosure during its storage, transfer, and/or transmission. We use Secure Sockets Layer (“SSL”) protocol for this purpose.

We take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the internet or any wireless network can be guaranteed to be secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations that are beyond our control; and (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through the Network cannot be guaranteed.

Right to Deletion

Subject to certain exceptions below, on receipt of a verifiable request from you we will:

  • Delete your personal information from our records; and
  • Direct third parties to delete your personal information from their records.

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service reasonably anticipated within the context of our business relationship with you, and/or otherwise perform a contract between you and us;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and/or prosecute those responsible for such activity;
  • Debug to identify and repair errors that impair existing or intended functionality;
  • Exercise free speech, ensure the right of another’s free speech, or exercise another right provided by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to applicable ethics and privacy laws if deletion is likely to render impossible or seriously impair such research, provided we have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
  • Comply with an existing legal obligation; or
  • Otherwise internally use your personal information in a lawful manner that is compatible with the context in which you provided the information.

Email Communications

From time to time, we may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our services, we may receive a notification when you open an email from us or click on a link therein.

You may opt out of receiving marketing or promotional emails from us by clicking on the UNSUBSCRIBE button or by sending an email to Info@SwyftOps.com with “UNSUBSCRIBE” in the subject line.

Data Retention for European Union Residents

In accordance with GDRP requirements, and upon your request, we will provide you with any of your personal data. We will retain your personal data for as long as you have consented to receive our communications or until such time as you request that we cease storing your personal data. We may also retain and use your information in order to comply with our legal obligations, resolve disputes, and prevent abuse.

Children Under Thirteen

We do not knowingly collect, either online or offline, personal information from people under the age of 13. If you are under 13, you may use the Network only with permission of a parent or guardian.
